The Right to Information Act, 2005 provide the right to every citizen to secure access to information under the control of public authority, in consistence with the public interest, in order to promote openness, transparency and accountability in administration and in relation to matters connected therewith or incidental thereto.

In terms of provisions of Section 5 & 6 of The Right to Information Act 2005, Brahmaputra Valley Fertilizer Corporation Limited (BVFCL), Namrup, P.O.: Parbatpur-786623, Dist. Further, in accordance with the provisions of Section 19 of the said Act, any person who does not receive a decision within the time specified in the Act from the Public Information Officer / Alternate Public Information Officer of BVFCL or is / are aggrieved by a decision of the Chief Public Information Officer/ Alternate Public Information Officer of BVFCL may within 30 days from the expiry of such period or from the receipt of such a decision prefer an appeal to the Brahmaputra Valley Fertilizer Corporation Limited (BVFCL) Namrup, P.O.: Parbatpur-786623, Dist. Dibrugarh (Assam).

Under the provisions of Section 4, sub-section 1, clause B, of Right to Information Act, 2005. Following 17 manuals are required to publish within 120 days from the enactment of the Act:

  1. THE PARTICULARS OF BVFCL’S ORGANIZATION AND FUNCTIONS AND DUTIES.Our official web site contains this information at “Profile”.
  2. THE POWERS AND DUTIES OF OFFICERS AND EMPLOYEES.BVFCL has defined powers for company official at different level. The duties are as assigned from time to time. The employees mainly work for the operations and maintenance of Plants.
  3. THE PROCEDURE FOLLOWED IN THE DECISION-MAKING PROCESS, INCLUDING CHANNELS OF SUPERVISION AND ACCOUNTABILITY.The decision making process is based on the delegation of authorities to various officers. The organization chart is available on our websites.
  4. THE NORMS SET BY BVFCL FOR THE DISCHARGE OF ITS FUNCTIONS.Each department of the company, while discharging its function, is guided by the Departmental Manuals, which are periodically reviewed and updated.
  5. THE RULES, REGULATIONS, INSTRUCTIONS, MANUALS AND RECORDS, HELD BY BVFCL OR UNDER ITS CONTROL OR USED BY ITS EMPLOYEES FOR DISCHARGING ITS FUNCTIONS.The Memorandum and Articles of Association provide the overall framework of the rules and regulations to be followed by the Company.
  • Each Department of the Company, while discharging its function, is guided by Departmental Manuals, which are periodically reviewed and updated. In addition to that the employees are regulated by the Standing Orders for workmen and Conduct, discipline and Appeal Rules for the Officers of the Company.
  1. A STATEMENT OF CATEGORIES OF DOCUMENTS THAT ARE HELD BY BVFCL OR UNDER ITS CONTROL.BVFCL hold commercial and technical documents relating to the business operations of the Company in the form of files, registers and /or electronic formats, as per the requirement of the company from time to time and as provided for under the various statutes.
  2. THE PARTICULARS OF ANY ARRANGEMENT THAT EXISTS FOR CONSULTATION BY THE MEMBERS OF THE PUBLIC IN RELATION TO THE FORMULATION OF ITS POLICY OR IMPLEMENTATION THEREOF.BVFCL being a commercial entity, its policies relates to internal management and, hence, there is no arrangement for consultation with members of the public. All of its policies are formulated in compliance with applicable provisions of statutes, regulations etc., by the Board of Directors of the Company.
  3. A STATEMENT OF THE BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES CONSISTING OF TWO OR MORE PERSONS CONSTITUTED AS ITS PART OR FOR THE PURPOSE OF ITS ADVICE, AND AS TO WHETHER MEETINGS OF THOSE BOARDS, COUNCILS, COMMITTEES AND OTHER BODIES ARE OPEN TO THE PUBLIC, OR THE MINUTES OF SUCH MEETINGS ARE ACCESSIBLE FOR PUBLIC.The following are Board of Directors of the Company:

The terms of reference of Remuneration Committee shall be in compliance with the DPE Guidelines issued by the Ministry of Heavy Industries and Public Enterprises from time to time.

The Management of the Company has constituted various Adhoc committees internally on need basis.

The Meetings of the Board of Directors, Audit Committees and Remuneration Committee are neither open to public nor the agenda/ minutes are accessible to public. However, important information/ decisions regarding the company and its management are being communicated to the various statutory authorities of State and Central Government.

  2. PROCEDURE FOR MAKING APPLICATION:1. WHO CAN SEEK INFORMATIONAny citizen of India who desires to obtain any information under the Right to Information Act, 2005 may make a request, preferably in the Application Format, in writing or through electronic means, to the Information Officer of the Company.2. APPLICATION FEE The application for obtaining information must be accompanied by the following prescribed application fee in favour of “BRAHMAPUTRA VALLEY FERTILIZER CORPORATION LIMITED, PAYABLE AT NAMRUP, where the application has been submitted. If cash is paid, a copy of the receipt is to be enclosed. At present, the applicable rates, for additional fees which are subject to change from time, are given as under:

a For each page (in A-4 or A-3 size paper) created or copied Rs. 2/- per page

d For inspection of records No fee for the first hour; and a fees of Rupees five for each fifteen minutes
(or fraction thereof) thereafter

Further, for providing the information under sub-section 5 of Section 7 of the RTI Act, 2005, the fee shall be charged at the following rates :

a For information provided in diskette or floppy Rs. 50/- (Rupees fifty only) per diskette or floppy
b For information provided in printed form At the price fixed for such publication or Rs. 2/- per page of photocopy for extracts from the publication

The mode of payment of above mentioned additional fees shall be the same as applicable fee.

The Public Information Officer/ Alternate Public Information Officer will provide the information sought or reject the application within 30 days of the receipt of the application.

The application seeking information may be rejected in any of the following conditions:

  1. Not accompanied by prescribed fee
  2. Information which are prohibited from disclosure under the Act.

APPEAL :

In case the Requester who does not receive a decision within the time specified in sub-section (1) or clause (a) of sub-section (3) of section 7 of the Act, or is aggrieved by a decision of the Public Information Officer/ Alternate Public Information Officer, as the case may be, may within thirty days from the expiry of such period from the receipt of such a decision, prefer an appeal to the First Appellate Authority for redressal of the grievance.

WHAT IS NOT OPEN TO DISCLOSURE UNDER THE RTI ACT, 2005

The following is exempt from disclosure (Section 8)

  1. Information which affect the sovereignty & Integrity of India (Section 8 (1) (a))
  2. The security, strategic, scientific or economic interest of the State / Company (Section 8 (1) (a))
  3. Relation with foreign state or lead to incitement of an offence (Section 8 (1) (a))
  4. Information expressly forbidden to be published by any court of law. (Section 8 (1) (a))
  5. Information which would cause a breach of privilege of parliament or he state legislature (Section 8 (1) (c))
  • Information including commercial confidence, trade secrets or intellectual property which would harm the competitive position of the third party, unless the competent authority is satisfied that large public interest warrants the disclosure of such information. (Section 8 (1) (d))
  • Public Information Officer may reject a request for information where such a request for providing access would involve an Infringement of copyright subsisting in a person other than the state.
  1. Information available to a person in his fiduciary relationship (Section 8 (1) (e))
  2. Information received in confidence from foreign govt. (Section 8 (1) (f))
  3. Information, which would endanger the life or physical safety of any person or identify the source of information or assistance given in confidence for law enforcement or security purposes. (Section 8 (1) (g)).
  4. Information which would impede the process of investigation or apprehension or prosecution of offenders (Section 8 (1) (h)).
  5. Cabinet papers including records of the council of ministers, secretaries & other officers Section 8 (1) (i)).
  6. Information which relates to personal information having no relationship to any public activity or which would cause unwarranted invasion to the privacy of the individual Section 8 (1) (j).Following shall be the expectation:Information normally given to the Parliament or State Legislature has to be made available to the person seeking the information under this Act (Section 8 (1)
  7. Is partial disclosure allowed?” Information which can reasonably be severed from any part that contains exempt information may be provided. [S.10]
  8. What is the process for rejecting a request?The Central Public Information Officer shall communicate to the person making the request [Section 7 (8)]A. The reasons for such rejection
    B. The period within which an appeal against such rejection may be preferred; and
    C. The particulars of the first appellate authority. An information shall ordinarily be provided in the form in which it is sought, unless it would disproportionately divert the resources of the public authority or would be detrimental to the safety or preservation of the record in question [Section 7 (9)].
